TERMS & CONDITIONS

 

In order for Travelsmart Vacation Sdn. Bhd. to provide our utmost service to our valued customers. Customers are deemed to have read, understood & accepted the following conditions upon booking. Travelsmart Vacation Sdn. Bhd. shall be known as “The Company” in the conditions below.

The Company reserves the right to change these terms and conditions at any time without prior notice. In the event that any changes are made, the revised terms and conditions shall be updated immediately with attachment with invoice.

TERMS OF USE - HOTELS/ACCOMMODATION/CRUISE

The Company does not in any way (directly or indirectly, independently or in conjunction with any party) own, manage, operate or control the Hotels or Cruises, or any room in such Hotels or Cruises. The Hotels or Cruises are liable and responsible for providing accommodation and welcome people who have booked through The Company as their guests.

You agree to indemnify and hold harmless The Company from and against any liability, damage or loss including legal fees and expenses that The Company incurs or suffers as a result of any action, inaction or omission by you. If you use the Site for or on behalf of a third-party ("Third-party"), such as a family member or a traveling companion, you are responsible for any error in the accuracy of information provided in connection with such use. In addition, you must inform the Third-party of all applicable terms and conditions. Each customer using the Site for or on behalf of a Third-party agrees to indemnify and hold The Company harmless from and against any and all liabilities, losses, damages, suits and claims (including the costs of defence), relating to the Third-party's or the user's failure to fulfil any of its obligations as described above.

You are at all times bound by the local laws and regulations. Things which are legal in certain countries may be illegal in others. You should enquire about applicable restrictions. The Company cannot be held liable in case a Hotel or Cruise refuses to check you in or asks you to leave for legal or regulatory reasons.

For the avoidance of doubt, the Terms of Use do not apply to commercial contractual relationships The Company may have with others, including but not limited to the Hotels and certain marketing partners.

TERMS OF USE – TOUR ARRANGEMENT

Service providers are to ensure smooth service. Customers are urged to follow instructions given. Please contact The Company immediately should there is any issue arise. Emergency contact will be provided for all tours. The Company will not entertain irrational claims made only after the tour without any immediate feedback upon issue arise.

RISK & LIABILITY

Every effort is made to ensure that your holiday arrangements are satisfactory and we accept liability for, but only to the extent of, any loss or damage sustained by you as a direct result of our negligence. In any event, our aggregate liability to you is limited to the amount you have paid to us for the relevant tour. You acknowledge and agree that there are inherent risks involved in participating in the tour, including without limitation possible contact with native fauna, unforeseen events and travel in remote locations. By making a booking, you agree to accept all risks associated with the tour. We exclude, and you unconditionally release us from, all liability, including without limitation in contract and in tort, for any cause or action, including any injury, damage, loss, cost, delay, additional expense or inconvenience caused directly or indirectly as a result of the inherent risks associated with the tour, or any force majeure events or other events which are beyond our control, including but not limited to war, civil disobedience, terrorism, insurrection, accident, explosion, sickness, fire, floods, severe weather, acts of Government, alteration or cancellation of scheduled air services, accidents to or failure of machinery or equipment or industrial action.

If we or our service providers are affected in any way by a force majeure event, we may in our discretion vary or cancel any itinerary or arrangement in relation to the tour as we consider necessary, without incurring any liability to you.

Each service provider is responsible for the part of the tour it conducts. Service providers are not our agents or employees and are not under our direct control. We therefore do not warrant the performance of any service provider. We do not accept, and you release us from, all liability for any injury, loss, damage, costs or expenses, including without limitation any property damage or personal injury, that you may suffer which arises out of any act or omission of a service provider or operator who provides services in connection with your tour. Any claim that you may have in relation to a service provider should be raised directly with that service provider.

You are responsible for any injury, loss, damage, costs or expenses arising through your own fault. You agree to indemnify us against all actions, proceedings, claims, demands, expenses and costs (including legal costs on a full indemnity basis and whether incurred by or awarded against us) as a result of, or arising in relation to, whether directly or indirectly, your participation in the tour or any act or omission by you in relation to the tour.

COMPLAINTS AND CLAIMS

Any complaint and/or claim shall be made known to The Company in writing form within 14 days from the date departure from destination. In the event, where customers require assistance from The Company to make a claim against a 3rd party, a service fee will be imposed. No responsibility is accepted if any complaint and/or claim not made.

NO VARIATION OF CONDITIONS

These terms and conditions shall not be amended or waived except by written agreement between you and the Company.

RESERVATIONS & BOOKING

All reservations and bookings are subject to space availability and confirmation.

Travelsmart Vacation Sdn. Bhd. serves the right to adjust the final price upon tour confirmation if exchange currency rate, petrol, or utilities fees at the travel destinations increase prior to trip departure. Price is subject to change without prior notice.

Travelsmart Vacation Sdn. Bhd. serves the right to replace hotel at destination with similar rank hotel during tour without prior notice.

DEPOSIT & PAYMENT

For booking placed more than 30 days before departure:

  1. High/peak season - A charge of 50% based on the total package price is required at the time of booking. The balance of the full payment must be made no less than 30 days prior to the date of departure.
  2. Low season/pre-season/promo package – Full payment based on the total package price is required at the time of booking, otherwise advised as only

For booking placed 15-30 days before departure:

  1. High/peak season – Full payment based on the total package price is required at the time of booking, otherwise advised as only
  2. Low season/pre-season/promo package – Full payment based on the total package price is required at the time of booking, otherwise advised as only

For flight booking:

  1. Full payment upon invoice issued, otherwise no booking will be proceed.

Failure to comply with the above terms may result in an automatic cancellation of your reservation and forfeiture of your deposit.

AMENDMENT CHARGES

  1. All bookings will incur a RM200/pax non-refundable fee if cancellation is made after
  2. Promo/no-cancellation items - An administrative charge of 10% based on the total package price will be levied for each amendment request after the
  3. Any other cost arising from the amendment will be borne by the passenger. No amendment can be made within 14 days prior to
  4. A change on the entire tour destination is considered as a cancellation and will be charge according to cancellation

CANCELLATION POLICY

You may cancel your booking at any time but must be made in writing to avoid misunderstanding. Please refer to the Cancellation Fee table below for charges that will apply in general. However final penalty is subject to individual booking condition, hotel cancellation policy, and etc.

Cancellation received prior to departure date for ground arrangement and package (exclude flight):

  1. More than 30 days – Forfeiture of RM200/pax
  2. Between 15 – 30 days – Forfeiture of 50% deposit
  3. 14 days and below - Forfeiture of 100% of tour price
  4. Low season/pre-season/promo package – Forfeiture of 100% price

Cancellation received prior to departure date for hotel only:

  1. More than 30 days – Forfeiture of 50% deposit
  2. Between 15 – 30 days – Forfeiture of 50% deposit
  3. 14 days and below - Forfeiture of 100% price
  4. Low season/pre-season/promo package – Forfeiture of 100% price

*Above cancellation policy is only in general. The hotel policy will overwrite the above cancellation penalty, please refer to terms upon quotation/booking.

 

Cancellation for flight:

  1. Full amount (100%) of airfare will be forfeited on promotional airfare or low cost air
  2. For non-promotional airfare will subjected to individual airline company terms and conditions + 10% of admin
